TEMPO.CO, Jakarta - Indonesia's National Commission on Human Rights (Komnas HAM) has confirmed that human rights violations occurred in the death of Affan Kurniawan, an online motorcycle taxi (ojol) driver who was fatally run over by a tactical vehicle belonging to the Jakarta Regional Police Mobile Brigade (Brimob).
This confirmation was delivered by Komnas HAM Commissioner for Monitoring and Investigation, Saurlin P. Siagian, after attending a police inquiry at the Professional and Security Division of the National Police Headquarters on Tuesday, September 2, 2025.
“There is definitely a violation of human rights, and we will prove what kind of human rights violation it is,” Saurlin said outside the Police Headquarters.
Inquiry into Brimob Officers
Saurlin explained that Komnas HAM has not yet determined whether the actions of the seven police personnel involved amount to serious violations. The commission is still investigating whether the incident was caused by negligence or deliberate intent.
During Tuesday’s inquiry, Komnas HAM questioned the seven Brimob members who were inside the tactical vehicle when Affan was killed. “We also conducted our own interrogation process, and we are now analyzing all the results,” Saurlin said.
According to Komnas HAM, there are indications of both ethical and criminal violations. Examination files compiled over the past few weeks will soon be handed over to the Police Criminal Investigation Agency (Bareskrim) for further legal action.
The tragedy occurred on Thursday, August 28, 2025, during unrest following a demonstration near the House of Representatives (MPR/DPR) complex in Jakarta. Affan was struck in front of the Bendungan Hilir Flats II in Pejompongan.
Video footage obtained by Tempo shows the Brimob vehicle continuing to move forward even after hitting the victim, while demonstrators ran after the vehicle, attempting to stop it. Police were also seen firing tear gas toward residential areas during the incident.
The National Police previously acknowledged criminal involvement by two officers who were in the tactical vehicle. Commissioner Cosmas Kaju Gae, who served as the commanding officer, and Chief Brigadier Rohmat, who drove the vehicle, are now facing criminal charges.
Meanwhile, five other Brimob personnel who occupied the back seats (First Brigadier Danang, Second Brigadier Mardin, Bharaka Chief Jana Edi, Bharaka Chief Yohanes David, and Second Inspector M. Rohyani) are accused of committing moderate ethical violations.
Brigadier General Agus Wijayanto, Head of the Monitoring, Investigation, and Professional Development Bureau (Wabprof) at Professional and Security Division, said these violations could result in demotion or reassignment. “The decision will be made in an ethics hearing,” Agus stated.
