TEMPO.CO, Jakarta - The Indonesian Attorney General's Office has designated a state prosecutor to serve as legal counsel for Vice President Gibran Rakabuming Raka in a lawsuit seeking Rp125 trillion in damages.
According to the Head of Public Relations for the Attorney General's Office, Anang Supriatna, the lawsuit against Gibran was filed with the Vice President's Secretariat (Setwapres).
"The Attorney General has received a special power of attorney from the vice president," Anang stated on Monday, September 8, 2025. This mandate led to the appointment of the state prosecutor to represent Gibran in the legal proceedings.
During a hearing at the Central Jakarta District Court that same day, the plaintiff, HM Subhan, objected to Gibran’s use of a state prosecutor.
The issue came to light when the panel of judges began to examine the legal standing of both parties. Subhan argued that he was suing Gibran as an individual, not in his official capacity as vice president.
"I sue Gibran as an individual. If a state prosecutor is appointed, it means the state is involved," Subhan asserted.
The panel of judges subsequently returned the power of attorney to the state prosecutor, who then left the courtroom without making a statement to the media.
The General Election Commission (KPU), named as the second defendant, was represented by its legal counsel, and the court proceeded to examine its legal standing. The Chief Judge, Budi Prayitno, concluded the session by stating, "The trial is postponed for the summons for the first defendant."
Details of the Lawsuit Against VP Gibran
The lawsuit, initiated by attorney Subhan Palal, alleges that Gibran Rakabuming Raka did not meet the educational qualifications for a vice-presidential candidate, specifically the requirement of a high school diploma or its equivalent.
Earlier, the Spokesperson for the Central Jakarta District Court, Sunoto, had detailed the petitum, or demands, of the lawsuit. Subhan has asked the court to declare that both Gibran and the General Election Commission committed unlawful acts. Furthermore, the plaintiff seeks to have Gibran's status as Vice President for the 2024-2029 term declared invalid.
In addition, Subhan requested that the defendants be held jointly and severally liable to pay material and immaterial damages amounting to Rp125 trillion to the plaintiff and all Indonesian citizens. This substantial sum is intended to be deposited into the state treasury.
Subhan also demanded that the court's decision be immediately enforceable, regardless of any appeals or cassation by the defendants.
"To sentence the defendants jointly and severally to pay a penalty (dwangsom) of Rp100 million per day for any delays in executing this court decision," Sunoto quoted from the lawsuit's demands, in a confirmation on Wednesday, September 3, 2025.
