TEMPO.CO, Jakarta - The United Nations High Commissioner for Human Rights (UNHCHR) Volker Turk called on Israel Thursday to promptly adhere to its international legal obligations, as outlined in the International Court of Justice’s (ICJ) advisory opinion on Gaza.
The ICJ decision underscores that residents of Gaza and the entire occupied Palestinian territory must have access to basic needs.
Turk stressed that, according to the ICJ, international human rights law applies alongside international humanitarian law in the occupied Palestinian territory. Israel is therefore obliged to "respect, protect and fulfill the human rights of Palestinians," he said, as reported by Antara.
Turk explained that the court emphasized fundamental rights, including the right to life, freedom from torture or cruel treatment, security, freedom of movement, family protection, adequate living standards, health, education, non-discrimination, and self-determination.
"Israel – and all other States – must comply with the law as made clear in the Court’s ruling, and act swiftly to bring about meaningful improvements to the appalling human rights and humanitarian situation on the ground," Turk asserted.
He further added that all parties involved are mandated to fulfill their international legal obligations, beginning with the immediate priorities of "saving lives rather than placing them at grave risk, and flooding Gaza with much-needed aid."
He stressed that this immediate action "must be the first step towards recovery and peacebuilding anchored in human rights, so that the ceasefire in Gaza transforms into enduring peace, in line with international law."
The UNHCHR's call follows the ICJ's ruling on Wednesday. Based on the Geneva Convention, the court ruled that Israel must approve and facilitate the aid scheme provided by third countries and neutral humanitarian organizations, including the International Red Cross and UNRWA, to ensure sufficient aid reaches the Gaza Strip.
