KPK Revises Gratuity Rules to Simplify Reporting System

TEMPO.CO, Jakarta The Indonesian Corruption Eradication Commission (KPK) has revised KPK Regulation Number 2 of 2019 concerning Reporting of Gratuities. This regulatory change aims to simplify the reporting and handling mechanisms for gratuities, making them easier for civil servants and state administrators to understand and implement.

KPK Spokesperson Budi Prasetyo stated that the revision also aims to reduce differences in interpretations regarding gratuity reporting. "The KPK wants to encourage state officials to refrain from accepting gifts for personal gain, even under social or community pretexts," he said in a written statement on Wednesday, January 28, 2026.

Budi explained that one of the reasons for this regulatory change relates to adjusting the threshold for gratuities that are not required to be reported. The threshold for fair value in KPK Regulation Number 2 of 2019 previously referred to the results of surveys in 2018 and 2019. According to the KPK, this threshold is no longer relevant to current conditions and needs to be updated.

The changes also address the provisions regarding reports of gratuities submitted more than 30 working days after the date of submission to the Corruption Eradication Commission (KPK) or reports that have been found by the reporting agency's internal supervisors. In the latest regulations, the KPK provides clarity regarding the consequences of late reporting, including the possibility of the gratuity being declared state property.

Furthermore, the KPK highlighted the continued presence of gratuity reports that could not be followed up because they did not meet the elements of the crime of gratuity as stipulated in Law Number 20 of 2001, were formally incorrect, or the object of the gratuity lacked economic value. These conditions were then accommodated in the amendments to Article 14.

The KPK also amended the wording of Article 2 paragraph 3 regarding types of gratuities that do not require reporting. This change was made because many gratuity reports submitted to the KPK were found to fall into the category of non-reportable, necessitating simpler wording that is easier for reporters to understand.

Another change concerns the mechanism for signing decrees, as stipulated in Article 19. While previously the signing authority was determined based on the value of the gratuity, it is now adjusted based on the reporter's position level. The Corruption Eradication Commission (KPK) believes this new regulation is more flexible and adapts to the dynamics of authority within the institution.

With this revised regulation, the KPK hopes that the gratuity reporting system will be more effective and foster a culture of integrity among civil servants and state administrators.
