Harvey Moeis Faces Lawsuit to Return Rp73bn in CSR Funds

TEMPO.CO, Pangkalpinang- Tin smelter company PT Stanindo Inti Perkasa (SIP) has filed a civil lawsuit against Harvey Moeis, representing PT Refined Bangka Tin (RBT), demanding the return of Rp73 billion in CSR funds. The case was lodged with the Pangkalpinang District Court on Wednesday, April 9, 2025.

PT SIP’s legal counsel, Andi Kusuma, said the funds were provided to support public welfare in Bangka Belitung but were misused. “We demand Harvey Moeis return the CSR money intended for the community,” he stated at the court. He confirmed the Rp73 billion remains earmarked for local residents.

Andi also revealed PT SIP’s intention to sue former PT Timah TBK President Director Mochtar Riza Pahlevi Tabrani and former Bangka Belitung Governor (2017–2022) Erzaldi Roesman Djohan, citing their alleged involvement. “We will provide further explanation in due course,” he said.

Smelter Owner’s Statement

PT SIP owner Suwito Gunawan, also known as Awi, previously addressed the origins of the CSR fund in a TikTok video posted by Andi Kusuma on January 14, 2025. He denied claims that the late Brigadier General Syaiful Zachri, former Bangka Belitung Police Chief, initiated the US$500-per-ton tin ingot CSR scheme.

“To my knowledge, the initiative came from Harvey Moeis and the former governor of Bangka Belitung (Erzaldi Roesman), not the police chief,” he said. “That accusation is slanderous—he never discussed the matter, let alone anything involving finances.”

Suwito clarified that PT SIP’s collaboration with PT Timah TBK involved smelting—not mining—using ore sourced from community miners and PT Timah’s partners. “I was never involved in mining under that partnership,” he said. “All smelted output was returned to PT Timah, which then sold or exported it independently.”

He added that the creation of CV entities associated with PT SIP was done to meet tax compliance requirements set by PT Timah, including VAT and income tax. All state obligations—royalties, water tax, reclamation guarantees, land rent, and property tax—were fully paid, he claimed.

A CV, or Commanditaire Vennootschap, is a simple Indonesian business entity structure with active and silent partners. It is often used to fulfill tax and administrative requirements, as in the case of PT SIP and PT Timah.

“Why am I being held liable for state losses from tin ore purchases and smelting, when it is clear that PT Timah managed the entire process?” Suwito argued. “The smelted tin was retrieved and resold by PT Timah.”

He urged President Prabowo Subianto to intervene and ensure a fair investigation. “Everyone talks about Rp300 trillion, but they have no idea that figure is based on a prank calculation,” he said.
