TEMPO.CO, Jakarta - It took less than three hours for Constitutional Court justices to decide a judicial review of Law No. 2/2002 on the Indonesian National Police in early November 2025. The petition challenged the placement of active-duty police officers in civilian posts.
The justices granted the petition, requiring active-duty police officers who held civilian positions to resign or take early retirement. “There were also dissenting opinions, and some justices agreed to grant the petition but on different grounds,” Constitutional Court Chief Justice Suhartoyo told Tempo in Central Jakarta on Thursday, December 11, 2025.
In the Police Law review, six justices agreed that active-duty officers must resign or retire when serving outside the police structure. Two others, Daniel Yusmic and Guntur Hamzah, rejected the petition from the outset. Anwar Usman, the uncle of Vice President Gibran Rakabuming Raka, was absent from the judges’ deliberations.
Two Constitutional Court officials said that during the hearings an idea emerged to add a transitional period to implement the ruling. According to the sources, one justice argued that the Court should give the police two years to sort out personnel placements across ministries and agencies.
