TEMPO.CO, Jakarta - An Instagram account [archive] shared a video claiming that President Prabowo Subianto enacted a death penalty law for corruptors on February 10, 2026. The footage shows a heated plenary session at the House of Representatives (DPR) building, with several council members rising from their seats and crowding the presiding officer's desk.

The post included a narrative that council members panicked after Prabowo announced the enactment of the law. However, is the video actually about Prabowo issuing a death penalty law for corruptors?

Tempo verified the content through reverse image searches and credible news reports. The investigation revealed that the footage depicts sessions of leadership elections for the House of Representatives (DPR) and the Regional Representative Council (DPD).

This clip is identical to a video uploaded by the Kompas.com YouTube channel on October 1, 2024. The footage captures a chaotic Regional Representative Council (DPD) leadership election on October 1, 2024. Tensions flared over allegations of fraud during a standoff between candidates Sultan Bachtiar Najamudin and La Nyalla Mahmud Mattalitti.
Sultan Bachtiar Najamudin won the DPD Speaker election with 95 votes, while La Nyalla garnered 56.

This clip shows a plenary session to determine the DPR leadership. Several members are seen storming the interim leader's desk in protest. This footage was originally broadcast as "Breaking News" by the BeritaSatu YouTube channel on October 2, 2014.

Death Penalty for Corruptors in the Corruption Eradication Law
To date, the government and the DPR have not enacted a new law specifically regarding the death penalty for corruptors. Capital punishment for corruption is already regulated under Law Number 31 of 1999on the Corruption Eradication, later amended by Law Number 20 of 2001.
Article 2, paragraph 2 of this regulation states: "In the event that the criminal act of corruption as referred to in paragraph (1) is committed under certain circumstances, the death penalty may be imposed."
Despite this framework, the National Human Rights Commission in 2021 stated that the death penalty is not the solution to eradicating corruption, as it violates the right to life–an absolute human right. Although Article 6, paragraph 2 of the International Covenant on Civil and Political Rights (ICCPR) condones the practice, its application is limited to the most serious crimes, such as genocide, crimes against humanity, and war crimes.
