Immigration Arrests Chinese Nationals for Working Illegally in Tangerang

TEMPO.CO, Jakarta - The Immigration Office Class I Special Non-Examination Place (TPI) in Tangerang has arrested two Chinese nationals suspected of violating immigration regulations. "They were working as construction workers and foremen without permission," said the Head of Immigration Class I Non-TPI Tangerang, Hasanin, in a statement received by Tempo on Thursday, April 17, 2025.

Hasanin mentioned that the arrest of the two Chinese nationals with the initials XZ and ZJ resulted from routine immigration surveillance carried out at two locations in Tangerang: the office area of Green Lake City in Cipondoh on April 10, 2025, and in the office area of Pantai Indah Kapuk 2 on April 2, 2025.

"During surveillance at Green Lake City, officers discovered XZ working as a construction worker," he said, adding that XZ was observed cutting wood for furniture, assembling display racks, and aluminum frames.

Meanwhile, at PIK 2, ZJ, a foreman sent by his company's headquarters in China, was preparing for the opening and overall operation of the company in Indonesia.

According to Hasanin, the investigation revealed that both XZ and ZJ held Tourist Visit Stay Permits (B1 index), which, based on the Minister of Immigration and Law Decree Number M.IP-09.GR.01.01 of 2024, are intended for activities such as tourism, attending as participants meetings, incentives, conventions, and exhibitions (MICE), and non-commercial activities like gatherings and medical treatment in Indonesia.

"[These permits] prohibit exceeding the length of stay, engaging in trade, and receiving remuneration or similar from individuals or corporations in Indonesia," said Hasanin.

Hasanin further stated that XZ received wages, salary, and company-funded housing. On the other hand, ZJ received company-funded accommodation while in Indonesia, which Hasanin stated violates the conditions of their B1 Visa.

He stressed that XZ and ZJ are suspected of violating article 122 letter a of Law Number 6 of 2011 concerning Immigration, which carries a maximum penalty of five years imprisonment and a fine of Rp500 million.

Hasanin explained that as a follow-up, if sufficient evidence of immigration violations is found, a formal investigation will be conducted.

"If sufficient evidence is not found, then Administrative Immigration Measures will be taken in the form of deportation and a ban [from re-entering] due to administrative violations," said Hasanin.
