
TEMPO.CO, Jakarta - President Prabowo Subianto has signed Government Regulation (PP) No. 29/2025 concerning the Assistance Fund for Victims of Sexual Violence Crimes (DBK-TPKS). This regulation serves as a derivative of the Sexual Violence Crimes Law enacted in 2022.
However, Asry Alkazahfa, a researcher from the Institute for Criminal Justice Reform (ICJR), noted that the regulation does not rigidly outline the mechanism for the state to pay restitution to victims. "The PP DBK is an initial step for the state to concretely uphold the rights of sexual violence victims. However, there are still four crucial aspects that need to be considered," Asry said in her official statement on Tuesday, July 1, 2025.
Asry explained that the PP DBK-TPKS falls short in addressing practical issues in the field, particularly the critical role of law enforcement agencies in implementing restitution. "This regulation should be able to strengthen coordination between the LPSK (The Witness and Victim Protection Agency) and the Prosecutor's Office for the calculation of the perpetrator's assets or wealth," she emphasized.
Furthermore, while the Sexual Violence Crimes Law stipulates that the state can assist in paying restitution to victims using the state budget, Asry highlighted that the funding source in the regulation has not been clearly regulated. "Clarity on state funding is important to ensure stable financial support," she added.
Asry continued that the new policy also lacks specificity regarding when victims can apply for recovery funding from the LPSK. There is no clear time limit for victims to access this funding. "The PP DBK-TPKS also does not meet the urgent needs of victims who require immediate assistance," she asserted.
Therefore, Asry suggested that Bappenas (National Development Planning Agency), the Ministry of Finance, and the LPSK should coordinate to clarify the state budget allocation for the assistance fund and issue explicit policies on this funding. She also recommended that "LPSK and UPTD PPA (Integrated Service Center for Women and Children) must clarify the concept of recovery funding through the victim assistance fund to reach all aspects of victims' recovery from sexual violence crimes."
Additionally, Asry stressed that the police and the Prosecutor's Office should coordinate from the early stages of examining sexual violence cases to evaluate the perpetrator's assets or wealth, which would serve as a guarantee for the payment of victims' restitution.
"The police are obliged to inform sexual violence victims of their inherent rights and provide information and access to the Victim Assistance Fund from the moment the victim reports the sexual violence incident they experienced," she concluded.
