Brazil Gov't Not Suing Over Juliana Marins' Death, Says Indonesian Minister

TEMPO.CO, Jakarta - Coordinating Minister for Political and Security Affairs, Budi Gunawan, addressed the impending lawsuit regarding the death of Brazilian citizen Juliana Marins. He clarified that the legal action against Indonesia is not initiated by the Brazilian government.

"The lawsuit was filed by the family and through a non-governmental organization. It did not come from the government," he said when met at the Parliament complex in Senayan, Jakarta, on Monday, July 7, 2025.

Gunawan emphasized that the Indonesian government continues to maintain strong diplomatic ties with the Brazilian Embassy. He mentioned that President Prabowo Subianto directly discussed the case with Brazilian President Luiz Inácio Lula da Silva during his recent visit.

"President Prabowo has been to Brazil and discussed this a little. We are maintaining good relations," he affirmed. However, he stopped short of detailing the discussion.

President Prabowo's visit to Rio de Janeiro from July 6-7, 2025, was to attend the BRICS (Brazil, Russia, India, China, and South Africa) High-Level Conference.

Juliana Marins died after falling while hiking Mount Rinjani on June 21. Due to challenging weather and difficult terrain, the search and rescue (SAR) team could only successfully evacuate her four days later.

Previously, various reports indicated that Brazil was demanding accountability from Indonesia for Juliana Marins' death. The plan to sue was initially revealed by The Federal Public Defender's Office of Brazil (FPDO), a human rights observer in the country. The FPDO intends to pursue legal action if further autopsy results suggest negligence contributed to the 26-year-old's death. In contrast, the Indonesian government maintains that Juliana's death was purely accidental, based on its autopsy findings.

Coordinating Minister for Legal, Human Rights, and Immigration, Yusril Ihza Mahendra, said that Indonesia cannot be sued in this case. According to Yusril, Indonesia is not a member or party to the international forum where such a lawsuit might be filed. "You cannot bring a country into a forum if that country is not a party to the convention," he explained at a press conference on Friday, July 4, 2025.

Yusril further clarified that Indonesia cannot be directly sued in institutions like the International Court of Justice (ICJ) or the International Criminal Court (ICC) without its consent. "It can only be done if there is approval from the relevant country [to participate in the forum]," Yusril added.

As an alternative, Yusril proposed that Brazilian authorities, along with the Indonesian government, conduct a joint investigation. "Whatever the conclusion of the joint investigation, if approved by the Brazilian government, will be revealed," he concluded.
